2001 Tax Rate Rollback Elections

PTD Found 4 of 34 Taxing Units Limited Tax Rate

The Comptroller’s Property Tax Division (PTD) has learned that voters in only 4 of 34 taxing units limited the 2001 tax rate. They included two school districts, one city, and one special district.

Some 28 of 30 independent school districts (ISDs) held successful elections to retain their 2001 tax rates. Only two school districts — Spring Creek ISD in Hutchinson County and Groesbeck ISD in Limestone County— had voters disapprove their higher adopted tax rates. The December 2001 STATEMENT highlighted these elections, but did not include Groesbeck ISD (reported after publication).

Jim Hogg County was the only county with a rollback election, and it failed. About 861 county voters voted against the rollback, with 535 voting for the tax rate rollback. The county retained its adopted rate of $1.21 per $100 of value.

Two cities held rollback elections, with one passing and one failing. The City of Chandler in Henderson County had its tax rate rollback from $0.3326 to $0.2471. Voting to roll back the tax rate were 253 voters, with 160 against the rollback. The City of Oak Point in Denton County had its rollback election fail, so it retained its rate of $0.6440. The vote margin was 402 against the rollback and 267 for the rollback.

The only special district with a rollback election was Muenster Hospital District in Cooke County, where the rollback election passed. The hospital district had to reduce its tax rate from $0.4982 to $0.2572. The vote was 573 for the rollback and 246 against the rollback.

The table below lists the taxing units, with the election date, election results, the adopted tax rate, the rollback tax rate, and the percentage the adopted tax rate exceeded the district’s rollback rate. Tax rates are per $100 of value.

The table below gives the history of successful rollback elections since they began in 1982.

Unlike other types of taxing units, a school district that adopts a tax rate above the rollback rate must hold a rollback election between 30 and 90 days after the rate is adopted. No petition by citizens is required. The school district’s election differs from other types of units in that voters are asked to ratify their school’s adopted tax rate. If a simple majority of the votes cast in the election favor the adopted tax rate, then the adopted rate stands. If the voters disapprove the adopted rate, the school district’s rollback rate becomes the adopted tax rate. After the outcome of the election, school tax bills are mailed.

Last year, six out of 16 taxing units had successful elections to rollback their 2000 tax rates.
