CAT Certifications and Committments
The Contract Advisory Team (CAT) conducting major contract solicitation reviews certifies the following statements to be true and correct. The CAT understands and agrees to be bound by the commitments contained herein.
The CAT and their respective agency's subject matter personnel assisting in major contract solicitation reviews agree not to disclose or otherwise divulge any information pertaining to the contents, status, or ranking of any major contract solicitation, as defined in Texas Gov't Code §2262.001, (to include referenced documents in the solicitation) to any person other than the CAT and any personnel in each of the CAT's agencies assisting the CAT with major contract solicitations reviews and as may otherwise be required by law.
The CAT understands the terms "disclose or otherwise divulge" includes, but are not limited to, reproduction of in whole or in part any major contract solicitations submitted to the CAT for review, or removal of same from designated areas without prior authorization from the CAT leader. The CAT agrees to perform any and all major contract solicitation reviews of said submittals in an unbiased manner, to the best of their ability, and with the best interest of the State of Texas paramount in all decisions.
Each member of the CAT and their respective agency's subject matter personnel assisting in major contract solicitation reviews conducting major contract solicitation reviews is acting of their own volition, in accordance to the duties entrusted to them by the State of Texas and not acting under duress.
No member of the CAT and their respective agency's subject matter personnel assisting in major contract solicitation reviews shall be employed by, or receive any compensation from, or receive any present or future economic opportunity, employment, gift, loan, gratuity, special discount, trip, favor, or service in connection with any major contract solicitation reviews from any involved entities in return for favorable consideration.
The CAT and their respective agency's subject matter personnel assisting in major contract solicitation reviews shall not participate in any major contract solicitation review if they have formed a pre-conceived position on the relative merits of the major contract solicitation submittal or if they have established a personal preference or position on the worth or standing of any entity participating in a major contract solicitation submittal.
