ORDERING INSTRUCTIONS:
All Purchase Orders must be entered through the TxSmartBuy on-line ordering
system through the "Add Quotes" feature to be qualified for the contract
pricing and discounst.
Section 1:
1.1 DESCRIPTION OF CONTRACT: 415-N1 Laboratory Freezers and Refrigerators.
1.2 TYPE: Non-Automated Discount from List.
1.3 TERM OF CONTRACT: July 24, 2007 through June 30, 2011
EXTENSION: July 1, 2011 through September 30, 2011
EXTENSION: October 1, 2010 through December 31, 2011
EXTENSION: December 31, 2011 through March 31, 2012
EXTENSION: April 1, 2011 through June 31, 2012
EXTENSION: July 1, 2012 through September 30, 2012
EXTENSION: October 1, 2012 through December 31, 2012
OPTIONS TO RENEW AT THE EXCLUSIVE OPTION OF THE STATE:
1st Renewal Exercised - July 1, 2008 through June 30, 2009
2nd Renewal Exercised - July 1, 2009 through June 30, 2010
3rd Renewal Exercised - July 1, 2010 through June 30, 2011
1.4 DELIVERY: 30 days after receipt of order (ARO) unless otherwise stated.
A. Late Delivery: If a delivery delay is foreseen, vendor shall give
notice to the qualified ordering entity and the Texas Comptroller of
Public Accounts (CPA). The qualified ordering entity or the
CPA has the right to extend the delivery date if reasons appear
valid. The vendor must keep the qualified ordering entity advised,
at all times, of the status of the order. If the vendor has orders
in their possession which have not been completed within the
specified delivery time, the CPA reserves the right to withhold
issuance of further orders until all orders have been filled and
acceptable assurance has been given that the event will not be
repeated.
B. Back Orders: Qualified ordering entities may purchase, on the open
market, any commodity reported by a vendor to be on back order when the
resultant delivery time is unsatisfactory. Damages may be applicable
in cases of a pattern of back orders.
C. Damage Assessment: If the vendor is in default on an order, the State
reserves the right to purchase the item in default and charge the
increase in price, if any, and cost of handling to the vendor.
Failure to pay a damage assessment is cause for contract cancellation
and/or suspension or removal of the vendor from the State's
Centralized Master Bidders List.
1.5 MINIMUM ORDER: None.
1.6 SPOT PURCHASE OPTION: None
1.7 ZONE: This is a statewide contract.
1.8 SHIPPING INFORMATION:
Orders totaling $250.00 shipped to a single destination - F.O.B. destination,
freight prepaid and allowed
Orders totaling less than $250.00 - shipped freight prepaid and added as a
separate item on invoice.
Qualified ordering entities must not be charged freight for partial shipments
of any order with a net total of $250.00.
1.9 WARRANTY: Manufacturer's standard warranty or two years parts and labor,
whichever is greater.
1.10 CASH AND EDUCATIONAL DISCOUNT: Not applicable.
1.11 QUANTITY OR LARGE ORDER DISCOUNT: Voluntary one-time price reductions
should be indicated on the invoice.

1.14 CONTRACTOR CATALOGS: Contact the contractors to obtain a copy of their
current catalog and/or price lists as detailed in the Contract
Information pages or for Internet access.
Section 2: - Specific Contract Requirements:
2.1 GENERAL SPECIFICATIONS FOR ALL UNITS:
All units are Commecial UL listed and have a minimum warranty of two (2) years on
parts and labor.
All freezer units have micro-processor control systems. Available features include:
* Touchpad data entry
* Adjustable safety alarms
* Low battery alarm
* Silent witness alert
* Automatic voltage boost and clean filter light
Vendor catalog offering contains units with left-hand door hinge option.
2.2 SPECIFICATIONS FOR ULTRA-LOW TEMPERATURE FREEZERS:
- Freezer cabinets are corrosion resistant.
- Freezer cabinet, less doors, are provided with insulation equivalent to 5" urethane
foam.
- Doors and/or lids are equipped with a 2-gasket seal or equivalent.
- Upright freezer inner doors are insulated.
- Chest freezers have sub-lids.
- Ultra-low temperature freezers include controls such as on/off switch, "on" indicator,
light alarm test, temperature set points (2 degrees Celsius increments minimum),
temperature display, uniformity to be within +/- one degree Celsius.
- Units include alarm, casters, 1" portholes, built in voltage boost systems, and
built-in door/lid key-locks.
2.3 SPECIFICATIONS FOR GENERAL PURPOSE LABORATORY FREEZERS AND REFRIGERATORS:
- All units must be Energy Star rated and Commercial UL listed.
- General purpose laboratory freezers and refrigerators cabinets shall be corrosion
resistant.
- Freezers and refrigerators doors shall be provided with insulation equivalent to
2" urethane foam, positive door seal, door storage shelves or compartments, and
door/lid lock.
- Vendor catalog offering includes units with microprocessor controls,
digital display and glass door options.
2.4 SPECIFICATIONS FOR SUPER INSULATION FREEZERS:
Thin wall construction design provides a high density insulation capable of
maintaining the R-value while decreasing the wall thickness from 5" to a
thickness of 3" or better.
2.5 ACCESSORIES:
Accessories are defined as any item that is a subordinate or supplemental
part or object used mainly for convenience, safety, ease of storage, etc.
Examples include, but are not limited to:
- Storage racks and boxes
- Additional shelves
- Cell dividers
- Casters
- Recorders
- Remote alarms and cooling back-up systems.
