1.1 DESCRIPTION OF CONTRACT: 200-A2 Uniform Shirts, Trousers/Pants/Shorts,
and Jackets.
For use by the Texas Department of
Public Safety, Texas Parks and Wildlife
Department, Houston Police Department, City of
Houston Parking Management, Houston Police
Department Mobility Response Team, and the Katy
Independent School District Police Department
1.2 TYPE: Automated Firm Price with Escalation
1.3 TERM OF CONTRACT: April 24, 2009 through April 30, 2010
Renewal Term: May 1, 2010 through April 30, 2011
Second Renewal Term: May 1, 2011 through April 30, 2012
Third Renewal Term: May 1, 2012 through April 30, 2013
RENEWAL OPTIONS:
4th Renewal: May 1, 2013 through April 30, 2014

1.7 ZONES: None - Statewide Contract
1.8 SHIPPING INFORMATION:
All shipping is F.O.B. destination. Prices include all shipping; handling
fees; fuel surcharges and any other related shipping/delivery.
Packaging and Labeling: Each shipped uniform is packaged separately and
labeled with officer's name and duty station clearly visible.
Hours for Delivery: Delivery will be made during the hours of 8:00 am to
4:00 pm (CST) of the Customer unless prior approval for after-hours
delivery has been obtained from the Customer. Contractor will obtain
customer's hours of operation at time of order.
Prompt Delivery: Delivered products which do not meet all the specification
requirements does not constitute delivery, and the late fee will apply
until the contractor delivers products in full compliance with the speci-
fications to customer's destinations.
1.9 WARRANTY: Manufacturer's standard warranty.
1.10 EARLY PAYMENT DISCOUNT: C & G Wholesale: 2% for invoice paid in 20 days
1.11 QUANTITY OR LARGE ORDER DISCOUNT: C & G Wholesale: 2% discount for total
quantity of 2,000 or more for each group of short sleeve shirts, or long
sleeve shirts, or trousers.

1.15 PURCHASE ORDERS:
Only orders issued through the CPA on-line purchasing system are eligible
for contract pricing.
1.16 ADDING NEW PRODUCTS TO THE CONTRACT:
Following the contract award, additional products of the same general category
that could have been encompassed in the award of this contract, and that are not
already on the contract, may be added. Customers are encouraged to request additional
items by contacting the TPASS purchaser at Yvette.marietta@cpa.state.tx.us
1.17 CONTRACTOR REQUIREMENTS:
A. Texas Department of Public Safety -
Contractor must provide the application of any customer's patches and
emblems, hems to any desired length along with any customizations the
specifications may call for. Uniforms purchased under this contract may
require special alterations to accomplish a more satisfactory fit.
Alterations and application of patches/emblems shall be provided at no
cost to the customer. The contractor must meet the following requirements:
Any shirt exhibiting a total of more than 3" of excess material in the
body, with or without the wearing of a ballistic vest underneath, whichever
may be the case for the officer being fitted, shall be altered at the
request of the customer.
Individuals may require an upsize in the slacks to obtain a proper fit.
Waist tapers and seat tapers will be provided when necessary. Additionally,
crotch alterations and waist "let out" alterations may be required.
Contractor will have an open exchange, return, refund, and credit policy.
Any garment not worn or laundered may be returned to contractor - no
questions asked. No re-stocking fee will be assessed on any returns.
B. Texas Parks and Wildlife Department -
1. Customization:
* Customizing will include, but not be limited to, hemming trousers
and sewing two (2) patches on each shirt and two (2) shoulder
patches and badge patch on outerwear garments.
* Patches will be provided to the vendor by TPWD.
* Patches are to be sewn on as indicated in the drawing attached to
these specifications.
2. Measuring Service (for Custom Made Items ONLY):
* To insure proper fit of uniforms, the vendor's representative will
measure each game warden once at the beginning of the contract
period. Thereafter, the proximately 525 game wardens will be
responsible for using the measuring guide for future orders.
* New game wardens will be measured at Game Warden Training Center,
4363 FM1047, Hamilton, Texas 76531. The estimated number of new
wardens is 45 to 55.
3. Ordering and Shipping:
* All items shall be distributed to the TPWD addresses identified in
Attachment D, Tab 1.2.
* Delivery is FOB destination. The shipping, handling and any other
related charges are included in the unit price of the item.
* The items will be processed and shipped within five (5) days after
receipt of the order.
* Orders not shipped within five (5) working days will be reported to
the State's Vendor Performance System.
* The vendor must inform the TPWD ordering personnel (listed under
each address) if the shipment is going to be delayed and when
shipment can be expected.
* All back orders shall be shipped within ninety (90) days from order.
* Back orders cannot exceed five percent (5) of the annual total
purchases.
* Should back orders be in excess of five (5) percent, renewal may be
disallowed and TPWD has the option to cancel any or all back orders.
4. Return policy:
* Unused items may be returned within thirty (30) days for full
refund or replacement.
5. Inventory:
* The vendor will maintain a level of stock on all items, less
agreed upon non-stocking items, to insure minimal back orders as
previously described.
* The vendor will maintain a level of inventory by size based on the
most popular sizes purchased.
6. Fabric:
* It is the sole responsibility of the vendor to insure ordering of
all fabric so as to comply with inventory requirements.
1.18 PRE-PRODUCTION SAMPLES:
A. Texas Department of Public Safety -
At the request of the customer, the Contractor will provide a
pre-production sample.
B. Texas Parks and Wildlife Department -
1. The pre-production samples may be required after award and are at
the expense of the bidder to include: all uniform products, order
guide and catalog.
2. All pre-production samples must meet specifications as written,with
the exception of color. The vendor will be furnished the sample
uniform (shirt and pants) from TPWD for color match. The color
must match TPWD custom color to provide a constant uniform
appearance.
